1. Introduction

Occhio GmbH strives to make its website accessible in accordance with the Accessibility Strengthening Act (BFSG), the Accessible Information Technology Ordinance (BITV 2.0), and Directive (EU) 2016/2102.

This accessibility statement applies to the official company website, including the store finder, product configurator, and all subpages.

2. Status of Compliance with the Requirements

This website is partially accessible in accordance with the aforementioned legal requirements.

Basis of Evaluation:

  • Internal self-assessment according to WCAG 2.1 (AA)
  • Use of automated test tools (e.g., axe, WAVE)
  • Manual sampling of pages with high user traffic
  • Evaluation conducted on 01.06.2025

A full implementation of accessibility is planned as soon as possible.

3. Non-Accessible Content

a) Non-compliance with legal requirements

  • PDF documents (e.g., catalogs, brochures) are not fully provided with structural tags.
  • Embedded videos (product pages, campaigns) do not consistently contain subtitles or audio descriptions.
  • Contrast of individual UI components (e.g., product filters, call-to-actions) does not fully meet WCAG criteria.
  • Form elements are not consistently provided with ARIA labels or optimized for screen readers.
  • Alternative text for images is partially missing for decorative or brand-oriented images.

b) Disproportionate burden

  • The 3D product configurator and interactive showroom elements cannot currently be offered fully accessible due to their technological complexity.
  • Temporary promotion pages and events, which are published at short notice, cannot yet be implemented fully accessible in every case.

c) Content outside the scope of application

  • External content such as Google Maps or embedded Vimeo videos are beyond editorial control and cannot be offered fully accessible.
  • Content published before June 25, 2025 has not yet been retroactively adapted.
  • Live video content is not subject to the legal obligation for accessible post-editing.

Occhio products impress with their unique attention to detail and exceptional depth in product quality. 

 

As proof of this quality, Occhio grants warranties in accordance with the conditions described below. 

 

I. General terms 

 

  1. Registration. Successful registration is required to receive the Occhio care warranty described in these warranty terms and conditions. 

    Registration is carried out by you as the customer and must be completed within the statutory warranty period of 24 months after purchase and contain the complete customer data, including a valid email address. The customer data required for processing the warranty (name, contact information, product data) will be forwarded to the respective service partner from whom the luminaire was purchased in order to document the successful completion of the warranty registration. The warranty conditions for Occhio care will be provided to you during registration or on the Occhio website on a permanent data carrier, e.g., by offering the option to download them as a PDF file. Alternatively, the warranty conditions can also be sent in a separate email. As part of the Occhio care warranty program, registered customers will receive regular information about new products, innovations, and sales and advertising content from Occhio. You may object to receiving this information at any time without affecting the validity of the warranty.

    The Occhio magic move warranty is automatically granted upon purchase of the Mito sospeso move and Mito cosmo move luminaire models equipped with the magic move function; registration is not necessary. The warranty conditions for the Occhio magic move warranty will be sent to you by email together with the invoice. 

 

  1. Purchase of the luminaires. The warranties under these warranty conditions apply to luminaires purchased either directly from Occhio or through an authorized Occhio dealer. A customer within the meaning of these warranty conditions is anyone who has purchased such a luminaire in this manner. 

  2. Start of warranty periods.  The warranty periods begin on the date of purchase.

  3. Warranty area. The warranty area covers Afghanistan, Åland Islands, Australia, Austria, Azerbaijan, Bahrain, Belgium, Brazil, Bulgaria, Cambodia, Canada, China, Ivory Coast, Croatia, Cyprus, Czech Republic, Denmark, Egypt, Estonia, Faroe Islands, Finland, France, Germany, Ghana, Greece, Guernsey, Haiti, Hong Kong, Hungary, Iceland, India, Indonesia, Iran, Ireland, Israel, Italy, Kazakhstan, Kenya, Kuwait, Laos, Liechtenstein, Lithuania, Luxembourg, Macao, Madagascar, Malaysia, Mali, Malta, Mexico, Monaco, Montenegro, Netherlands, Netherlands Antilles, New Zealand, Nigeria, Norway, Oman, Philippines, Poland, Portugal, Romania, Russian Federation, Rwanda, San Marino, Saudi Arabia, Singapore, Slovakia, Slovenia, South Korea, Spain, Swaziland, Sweden, Switzerland, Taiwan, Tanzania, Thailand, Turkey, Ukraine, United Arab Emirates, United Kingdom, United States, Vanuatu, Vietnam.

  4. Burden of proof. The customer bears the burden of proof for the prerequisites of the warranties granted under these warranty conditions. This does not imply any change in the burden of proof with regard to statutory warranty rights.

 

II. Warranty declaration

  1. Occhio care. Occhio grants customers a free of charge 5-year warranty (Occhio care) on all newly purchased Occhio luminaire models and spotlights after successful registration. 

  2. Occhio magic move warranty. For luminaires with the »magic move« function, Occhio also grants customers an additional 10-year warranty on the electric height adjustment (Occhio magic move warranty). 
    This warranty is free of charge for luminaires already delivered with the Occhio magic move warranty. For luminaires that have not yet been delivered with this warranty, it can be purchased by customers for a one-time payment from Occhio or an authorized Occhio partner at the currently applicable prices. In this case, the warranty also begins on the original date of purchase of the luminaire, not on the date of purchase of the warranty. 

 

III. Scope of warranties, exclusions

  1. Occhio care. The warranty covers material, design and/or manufacturing defects that occur within the warranty period and applies to the entire product, including LED malfunction. Excluded from the warranty are malfunctions of the electric height adjustment "magic move" and the scheduled deactivation of this function after 5,000 complete travel cycles. This case is covered exclusively by the Occhio magic move warranty. 

  2. Occhio magic move warranty. The warranty applies exclusively to the »magic move«  electric height adjustment system and covers in the event that it reaches the end of its maintenance-free service life within the warranty period and is therefore deactivated. This occurs after 5,000 complete travel cycles, whereby a complete travel cycle corresponds to raising and lowering the system over a distance of at least 20 cm.
    In addition, the Occhio magic move warranty covers defects and malfunctions of the electric height adjustment »magic move«  if these occur within the warranty period during normal use in accordance with the respective product and application specifications in the installation and operating instructions – even if the maintenance-free service life of 5,000 complete travel cycles has not yet been reached. 

  3. Removal and installation costs, transport costs. Removal and installation of the luminaire and its delivery to the Occhio partner for the purpose of processing the warranty are not included in the warranties and are carried out by the customer at their own expense.

  4. Exclusions. The following are excluded from the warranties: 

    1. Normal wear and tear and impairments caused by software errors;

    2. Damage caused by intentional or negligent behavior on the part of the warranty holder or third parties;

    3. Damage or functional impairments resulting from improper use (e.g., misuse or exceeding the intended use, failure to observe the installation or operating instructions, other improper use;

    4. Interference, repair attempts, or modifications to the luminaire by the customer or third parties;

    5. Functional changes due to material fatigue, contamination, or external influences (e.g., water, fire, mechanical stress);

    6. Deviations in the product's appearance, color, or design from the illustrations or information in our catalogs, brochures, or other sales documents;

    7. Products from other manufacturers that are sold as merchandise by Occhio but are not manufactured by Occhio;

    8. Exhibition items (e.g., PoS goods) that were already in use prior to purchase.

 

IV. Technical and usage-related requirements of the warranties

 

  1. General requirements for both types of warranty

    1. Professional installation of the luminaire by a qualified electrician; 

    2. Intended use in accordance with the respective product and application specifications in the installation and operating instructions; 

    3. Compliance with the specified operating parameters, in particular with regard to mains voltage and ambient temperature; 

    4. Exclusive use of light sources in accordance with IEC standards and approved for the respective luminaire in accordance with the installation instructions;

    5. Immediate replacement of light sources after reaching their service life; 

    6. Professional and regular performance of maintenance requirements.

 

  1. Additional requirements for the Occhio magic move warranty
    1. Proof of at least 5,000 complete movement cycles (see section III no. 2) or proof of a defect or malfunction of the "magic move" function within the scope of normal use during the warranty period – even if the 5,000 movement cycles have not yet been reached;
    2. Deactivation of the electric height adjustment after reaching 5,000 complete travel cycles or demonstrable failure of the "magic move" function as a result of a defect within the warranty period;
    3. The average use of max. five complete driving cycles per day must not be exceeded. Continuous operation with an average of more than five driving cycles per day is not considered normal use and excludes the warranty claim;
    4. The warranty may be claimed at the earliest 1,000 days after the date of purchase, except in the case of demonstrable defects or malfunctions that occur within this period during normal use. Section IV No. 2 lit. c.) remains unaffected. 

 

V. Warranty service

  1.   Occhio care. If, after examining a product reported as a warranty claim, it turns out that the defects complained of actually exist and are covered by Occhio care, Occhio is free, at its own discretion, to either remedy the defect, deliver a replacement of the same type or equivalent chosen by us, or refund the purchase price. 

    In the event of a replacement delivery, Occhio reserves the right to provide a technically upgraded model or a product with reasonable, minor differences in design and characteristics. 

    Replacement products or parts, insofar as they are covered by the warranty, are also subject to the warranty against material, manufacturing, and/or design defects for the remaining duration of the original 5-year warranty period of the replaced product or the product into which they are installed.

 

  1. Occhio magic move warranty. In the event of a warranty claim, Occhio will replace the luminaire with an equivalent, refurbished luminaire.

    The person entitled to the warranty will receive a refurbished replacement luminaire with a new drive unit free of charge. This may be used in individual components, but will correspond to the original luminaire in terms of function, surface finish, and features. If such a replacement luminaire is not available, an equivalent new luminaire will be provided.

    Within the 10-year period, the customer may assert the replacement claim several times, subject to the above conditions. In order to maintain warranty claims in the event of multiple claims within the 10-year period, each claim must be supported by complete documentation of the previous replacement procedures. 

  2. Procedure for non-existent warranty claims. If, after inspection, it is determined that the conditions for a warranty claim are not met, Occhio or its authorized partner will inform the customer accordingly and notify the customer of the estimated costs of a repair outside the warranty. If the customer accepts this offer, the luminaire will be repaired in accordingly. If the customer rejects the offer, the luminaire will be returned to the customer without repair and at the customer's expense.

  3. No extension of the warranty period. The warranty period of both warranties shall not be extended or restarted by the provision of warranty services; it shall continue to expire at the end of the original warranty period from the date of purchase.

 

VI.  Warranty processing

 

  1. Occhio care 

    1. Deadline for reporting defects. Defects that are attributable to a manufacturing and/or material defect must be reported in writing or in text form to the Occhio partner from whom the product was purchased within two weeks of their discovery.

    2. Documents to be submitted. The warranty claim must be accompanied by a proof of purchase with the date of purchase or equivalent proof with a clearly identifiable date of purchase.

    3. Processing via the Occhio partner. The warranty will be processed exclusively by the Occhio partner or the Occhio flagship store where the luminaire was purchased, not directly by Occhio. The Occhio partner will carry out a preliminary check of the warranty claim and, if necessary, organize the return of the product to Occhio. After the replacement luminaire has been checked and shipped by Occhio, it will be returned to the Occhio partner, who will then hand it over to the customer.

    4. Reservation of inspection and return. Occhio will then make a final decision on the warranty claim. Any necessary returns of the luminaire to Occhio will be organized by the Occhio partner at their expense. If, after inspection, it is determined that there is no warranty claim, the provisions under Section V.3 (Handling of non-existent warranty claims) shall apply.

  2. Occhio magic move warranty

    1. Deadline for reporting defects. The deactivation of the height adjustment upon reaching the maximum number of cycles must be reported to Occhio within two weeks of the deactivation occurring.

    2. Documents to be submitted. In addition to the documents listed in Section VI 1 lit b.), proof of the travel cycles must be provided, e.g., a screenshot from the Occhio air app.

    3. Processing by Occhio. The provisions of Section VI No. 1 lit d.) apply.

    4. Right of inspection and return. The warranty claim must be accompanied by the return of the luminaire fixture to be replaced to Occhio. Upon receipt of the returned luminaire fixture, ownership of the luminaire fixture shall pass to Occhio. The person entitled to the warranty shall only acquire ownership of the replacement luminaire fixture if the luminaire fixture to be replaced has been returned to in accordance with the instructions. A proper return is deemed to have been made if the luminaire is returned complete and undamaged (except in the case of a warranty claim). If, after inspection, it is found that there is no warranty claim, the provisions under V.3. ("Handling of non-existent warranty claims") shall apply.

 

VII. Transferability of warranties

The Occhio magic move warranty is transferable. No separate consent from Occhio is required for this. 

The Occhio care warranty is non-transferable and applies exclusively to the original purchaser. Any transfer requires the written consent of Occhio.

 

VII. Relationship to other rights, liability

  1. These warranties grant the customer additional rights beyond the statutory warranty rights. Statutory warranty rights and claims under the Product Liability Act are not limited by these warranty statements and can be asserted free of charge independently of and in parallel to these warranty conditions. This also applies to claims against the Occhio partner and/or installer. 

  2. The acceptance of a warranty claim by Occhio does not constitute any obligation or liability beyond the services expressly stated in these warranty conditions. In particular, Occhio shall not be liable under this warranty for any indirect damage, special or consequential damage, financial loss including loss of actual or expected profits, interest, income, expected savings or business, damage to goodwill, and damage of any kind incurred by third parties. In all other respects, Occhio's liability shall be governed exclusively by the applicable terms and conditions of sale. 

IX. Final provisions

  1. The legal relationship arising from and in connection with the warranty shall be governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods. 

  2. If the warranty beneficiary is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with the warranty declarations shall be Munich.
